1. LICENSE AGREEMENT

The license for this product is issued for use by a single individual only. You are permitted to install and use the product on up to two (2) separate computers, provided both are owned and used solely by you. Should you require access on additional systems, special permissions may be granted on a case-by-case basis. All sounds and samples included in this product are licensed to you, not sold, by Mindwave Soundworks for both commercial and non-commercial use in music production, sound design, video post-production, performances, broadcast, or other content creation and production contexts. You are free to use the sounds and samples within the purchased library for commercial recordings without needing to pay additional fees or credit Mindwave Soundworks.

THIS LICENSE IS NON-TRANSFERABLE AND STRICTLY PROHIBITS THE RESALE OR LEASING OF THE PRODUCT.

The license also prohibits the inclusion of content from this or any other Mindwave Soundworks library into any other virtual instrument or library without our explicit written permission. Furthermore, you are not allowed to redistribute this product or its sounds in any form, including but not limited to re-sampling, processing, embedding in software or hardware, or using them in any free or commercial libraries of music or sound effects. This includes any musical sample playback system or standalone product.

2. INTELLECTUAL PROPERTY AND WATERMARK POLICY

This product, along with its accompanying documentation, is protected by copyright and international treaties, as well as other intellectual property laws. Mindwave Soundworks retains full copyright and ownership over all recorded sounds, instrument programming, documentation, and musical performances included in this product. Any rights not expressly granted herein remain with Mindwave Soundworks. Unauthorized use, distribution, or reproduction of the product is strictly prohibited and will be considered a violation of the law. Mindwave Soundworks reserves the right to pursue legal remedies, including injunctive relief, against any violations.

 

Additionally, it is illegal to bypass or tamper with any protective measures that Mindwave Soundworks has embedded in the product. Please be aware that each product is embedded with a unique digital watermark linked to your specific serial number. If the product is used inappropriately or found in unauthorized music, you will be held legally responsible. As such, we strongly encourage you to keep this product secure and prevent unauthorized copying or use.

3. REFUND POLICY

All sales are final. Mindwave Soundworks does not offer refunds on any of its products.

4. LIMITED WARRANTY AND LIABILITY

To the fullest extent permitted by law, Mindwave Soundworks disclaims all warranties and guarantees, whether express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Mindwave Soundworks, along with its suppliers, distributors, and agents, will not be held liable for any incidental, indirect, or consequential damages arising from the use or inability to use this product. This includes, but is not limited to, any loss of profits, business interruptions, or data loss, even if such damages were foreseeable.

5. TERM OF LICENSE

This license agreement becomes effective as soon as the product is installed and will remain in force unless terminated. The license will terminate if you breach any of its terms or conditions. Upon termination, you agree to destroy all copies and contents of the product. Sections 2, 3, 4, and 7 of this agreement will survive any termination of the license.

6. NOT FOR RESALE (NFR) AND EDUCATIONAL USE (EDU) SALES

All Mindwave Soundworks products fall under the terms of this license unless otherwise specified. Products provided under an EDU license are strictly for use by students, faculty, or staff within educational institutions. Please note that not all products are eligible for the EDU Sales program.

7. BUNDLE AND UPGRADE TERMS

Bundle and upgrade purchases apply only to products available at the time of purchase. Customers who have purchased a bundle or an upgrade are not entitled to additional discounts or free products on future releases unless specifically stated by Mindwave Soundworks.

8. GENERAL PROVISIONS

(a) This license is governed by the laws of the United Kingdom. All disputes shall be settled in UK courts located in London, and not in any other jurisdiction. If either party prevails in any legal proceedings regarding this license, the winning party is entitled to reasonable attorney’s fees and court costs.

(b) This license represents the full agreement between the parties and supersedes any prior communications related to the subject matter of the license.

(c) By accepting this license, you confirm that you have read and understood its terms and agree to comply with them.

QUESTIONS & ANSWERS

• Can I use beats or sounds I create with Mindwave Soundworks products in my own music tracks?
  Yes, absolutely! We encourage it.

• Can I sell individual sound samples from a product in a sample pack?
  No, this is prohibited.

• Can I use sounds from Mindwave Soundworks in commercial projects, like movie trailers?
  Yes, no additional permission is required.

• Can I upload factory beats or expansion packs from Mindwave Soundworks into a sample platform (e.g., Splice)?
  No, you cannot redistribute factory content in this way.

• Can I upload original beats made using Mindwave Soundworks instruments to a sample platform?
  This may be allowed as long as the beat is entirely your own creation and not derived from factory content.

• Can I sell beats created using Mindwave Soundworks instruments in formats like .NKA?
